One issue with Microsoft EULA's, is that they can, and do change, every
time something is updated.

When it comes to potential lawsuits, the least expensive position is
usually the most risk adverse position.

If Bing copied Google, there wouldn't be anything new worth requesting.

If Bing did not copy Google, there wouldn't be anything relevant worth
